Think Twice about what you are LOSING before possessing and/or pulling the trigger.
As a "Mandatory" condition of supervision, the Court shall provide, as an explicit condition of a sentence of probation/supervised release for a felony, misdemeanor, or an infraction, the defendant NOT commit another federal, state, or local crime during their release. The Court may provide further conditions of probation/supervised release to include: refrain from possessing a firearm, destructive device, or other dangerous weapons.
Use or Carrying a Firearm During and in Relation to any Crime of Violence or Drug Trafficking offense may be sentenced as follows:
| POSSESSION During violent or drug crime? Imprisonment not less than 5 YEARS 18 U.S.C. §924(c)(1)(A)(i) | BRANDISHED During violent or drug crime? Imprisonment not less than 7 YEARS 18 U.S.C. §924(c)(1)(A)(ii) | DISCHARGED During violent or drug crime? Imprisonment not less than 10 YEARS 18 U.S.C. §924(c)(1)(A)(iii) |
| A person who violates section 922(g) of Title 18 and has three previous convictions by any court referred to in section 922(g)(1) of Title 18 for a violent felony or a serious drug offense, or both, committed on occasions different from one another, such person shall be imprisoned for not less than 15 YEARS. 18 U.S.C. §924(e)(1) |
